A) Greetings from Star Tracker!
Greetings from Star Tracker! In a nutshell, your use of Star Tracker signifies your agreement to these terms.
These are the terms of use for Star Tracker (Star Tracker Int AB, 559230-7572) and they are applicable to all users of the Star Tracker platform. Whenever we use the terms "We," "Our," or "Us," we're referring to Star Tracker Int AB. The term “Star Tracker” encompasses this platform and all the services we provide, including our Star Tracker iOS app, Star Tracker Android app, Star Tracker APIs, Star Tracker embeds, www.startracker.one, and all other Star Tracker websites. By utilizing Star Tracker, you are agreeing to these terms as well as our other posted policies, which include our Privacy Policy, Community Guidelines, and Benefit Guidelines. We encourage you to read these carefully and to reach out if you have any queries. For details about our data handling practices, please refer to our Privacy Policy and our Cookie Policy. We collect, use, and share information in alignment with these policies.


B) Your User Profile
Your User Profile To put it briefly: You must be at least 13 years of age to utilize Star Tracker. The responsibility for your account rests with you.
When setting up an account, it is imperative that you provide us with precise and truthful information, and you agree to keep this information up-to-date in the event of any changes. In order to create an account or use Star Tracker in any way, you need to be at least 13 years of age, and also old enough to give consent for the processing of your personal data according to the laws of your country (in some jurisdictions, we may allow your parent or guardian to provide this consent on your behalf). If you wish to have a creator page on Star Tracker or to purchase an offering or subscription, you must be at least 18 years of age, or have the explicit permission of your parent or legal guardian. To subscribe to an Adult/18+ creator or purchase an offering related to such creator, you must be at least 18 years old. You bear the responsibility for any activities that take place when someone is logged into your account, as well as for the security of the account. Please alert us promptly if you suspect that your account may have been compromised. For more information on account security, you can refer to our Security Policy.


C) Inappropriate Behaviour
Inappropriate Behaviour In a nutshell: Act responsibly and avoid violating our terms or policies.
You hold responsibility for all activities occurring under your account. If you breach our terms or policies, we reserve the right to terminate your account. Refrain from any illegal or abusive activities towards others, any misuse of Star Tracker from a technical standpoint, or any exploitation of Star Tracker in a way that was not intended and is harmful to us, such as using Star Tracker purely as a storage platform. If you are a creator receiving funds through Star Tracker, understand that your actions with these funds could potentially expose us to risk. Consequently, we may also monitor your activities outside of Star Tracker. For more comprehensive information, refer to our Community Guidelines and Security Policy. While these terms and our policies address most issues, should you devise a new and innovative way to harm Star Tracker or our community, we reserve the right to take action to prevent it.


D) The Creator's Journey
The Creator's Journey To encapsulate: A creator is an individual who sets up a page on Star Tracker to interact with Star Followers. These Star Followers purchase memberships or offerings on Star Tracker to support the creator’s works. There are numerous intricate details pertaining to payments, fees, taxes, and restrictions that you, as a creator, should thoroughly read.

D1) Your Creator Space 
To step into the role of a creator, simply initiate your page to begin offering memberships. By joining Star Tracker, you become a member of the Star Tracker community. You have access to the creator tools we provide, which offer a variety of features such as showcasing your works, interacting with the Star Tracker community, and providing merchandise to Star Followers through our merch service. Memberships are intended for your most avid followers. On Star Tracker, you can offer your Star Followers unique benefits that they desire, including extra access, merchandise, exclusive creations, and engaging community experiences. In response, you will receive steadfast support from your Star Followers, and revenue from memberships and offerings that Star Followers have purchased on Star Tracker.

D2) Transactions
Transactions As a creator, you have the option to offer services on Star Tracker either as one-time transactions or as automatically renewing subscriptions. Where feasible, we automatically convert the prices of these services into a Star Follower’s local currency using a conversion rate determined solely at our discretion. More information on this can be found here. We manage payment-related concerns such as fraud, chargebacks, and resolution of payment disputes. We aim to provide you with prompt access to funds you’ve accumulated on Star Tracker, depending on the level and type of Star Tracker service you've chosen. Different levels and types of Star Tracker services may have varied timelines for when funds are made accessible to you, and/or may necessitate that reserves of funds are temporarily withheld from you. More information on this can be found here. However, you may occasionally experience additional delays in accessing these funds. We may also restrict or withhold your access to these funds if our terms or policies are violated, or for compliance purposes, including the collection of tax reporting information. When this occurs, we make an effort to promptly communicate the reason to you. If you have any queries regarding blocked or withheld funds, please contact us. To safeguard creators, we may block payments from Star Followerss if we suspect fraudulent activity. Actions such as refunds to Star Followers and chargebacks from Star Followes can sometimes result in a negative balance in your account and any fees incurred from Star Tracker, as outlined below, may not be refunded to you when these refunds and chargebacks are processed. If your balance becomes negative, we reserve the right to recover those funds from future payments. To ensure Star Tracker remains a safe community for all, creators who share sexually explicit content or content that includes nudity are required to agree to certain additional requirements. If you are an Adult/18+ creator, you agree to verify that you are over the age of 18 through the means we request, confirm that each individual depicted in your creations is over the age of 18, and obtain written consent from each such individual to participate in your creations. A consent form template for this purpose can be found in our Help Center, where additional information about these requirements is also available. You agree to promptly provide us with this proof of age verification and consent if we request it.

D3) Charges As
Revised: "Charges As a creator, there are costs linked to your offerings and paid memberships on Star Tracker. The basic structure of these fees is outlined below, but the most up-to-date information can be found in our Help Center. These fees may increase with prior notice to you and may depend on the level and type of Star Tracker service you select, including whether you opt for Star Trackers paid membership service, free membership service, and/or service for facilitating one-time purchases:
• The platform fee, which may involve a fixed fee and/or is calculated as a percentage of successfully processed payments. For service levels and types that include merchandise, please note that we charge you for the merchandise's cost based on the quantity and SKUs of the associated items, in addition to the platform fee for using the merch service.
• Feature-specific fees, which may arise from the usage of certain Star Tracker features and may include a fixed fee and/or are calculated as a percentage of successfully processed payments.
• The payment processing fee, which is calculated as a percentage of successfully processed payments and a fixed fee per successfully processed payment, related to the cost of processing payments from Star Followers, including recurring billing, recovering declined payments, and combating fraud.
• The payout fee, a fee for transferring money you’ve earned on Star Tracker to your specified payout method, which may vary based on your chosen payout method.
• The currency conversion fee, which is calculated as a percentage of successfully processed payments made in a currency other than your payout currency.
You can view the fees for any membership subscription on your creator dashboard, but please be aware that this dashboard does not list the above-described payout fee.
If a Star Follower pays in a currency different from the one associated with their payment instrument, their associated financial institution may charge them a foreign transaction fee for that payment. We do not apply this fee, have no control over it, are unaware of whether the fee is applied, and do not receive any part of that fee.
Even when a star follower pays in the same currency as that associated with their payment instrument, if the start follower’s payment is processed in a country different from the one linked to their payment instrument, their associated financial institution may charge them a foreign transaction fee for that payment. We do not apply this fee, have no knowledge of whether the fee is applied, and do not receive any of the funds from that fee. However, our choices about payment processing may impact or potentially lead to this fee."

D4) Taxation
To meet our tax obligations, we collect tax identification details and, under certain circumstances, report this information and earnings to tax authorities as legally mandated. You are responsible for reporting any income, withholding, or other earnings-based taxes which may be due as a result of the money you’ve earned on Star Tracker. More details can be found in our Tax Help Center.
We are also responsible for various transactional taxes worldwide. These include, but are not limited to, Value Added Tax (VAT), Goods and Services Tax (GST), and other local service or sales taxes in non-US locations, collectively referred to as "VAT", as well as state sales tax in the United States. For more information about how we handle transaction taxes, please refer to our VAT guide and other Help Center articles. In areas where we are required to collect transaction tax from Star Followers, invoices presented to and payments processed from Star Followers will include the tier or custom payment amount plus the applicable tax. The applicable tax will be charged in addition to the price of a relevant transaction based on the benefits you indicate you will be offering. We will use the benefit categories that you assign to your membership or offering to calculate, collect, and remit the applicable taxes. You are responsible for ensuring that all your benefits are properly categorized using good faith efforts and to the best of your ability using the available tools. You agree to provide accurate information when engaging with the tier tools, sales tax weighting tools, and generally when listing and categorizing benefits within membership tiers and offerings. Once settled, the tax amount will be automatically deducted, and we will remit directly to the applicable taxing authority. A record of the transaction tax portion of the payment will be available on your earnings details page.
Amounts payable under this agreement between a creator and Star Tracker may include VAT or sales tax where applicable. Please refer to our Tax Help Center in this regard. You agree to provide us with any information and documents for accurate tax determination and compliance, as we request or as otherwise required.


E) The Star Follower Experience
Star Follower Overview In essence, a Star Follower is someone who subscribes and/or makes a purchase on Star Tracker, typically receiving special benefits from creators they support. Through a subscription or offering on Star Tracker, Star Followers can interact directly with creators using our provided tools, and engage with a community of Star Followers and creators.
As a Star Follower, your support for a creator may come with special benefits such as shoutouts, exclusive creations, or merchandise. Payments are made either on a one-time or automatically-renewing subscription basis. Star Tracker is the billing entity associated with this charge.
The timing and amount of each subscription or offering depend on the type of subscription or offering you select and the creator you support. You can view these details before purchasing the offering or starting the subscription, and you can monitor all your active subscriptions and your billing history.
To become a Star Follower, simply subscribe or purchase a paid subscription or other offerings on Star Tracker. Subject to terms and full payment of applicable charges, if a subscription or offering includes access to a creator’s creations, you receive a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and view those creations for your private, personal, non-promotional, non-commercial use. Creations you gain access to in this manner will generally continue to be available to you, but may occasionally become unavailable.
Star Tracker offers three types of paid, automatically renewing subscriptions. These include a monthly subscription, a per-creation subscription, and an annual subscription. Not all types of membership subscriptions are offered by all creators and the current subscription options for a given creator will be presented to you prior to entering the membership.
Each type of paid subscription automatically renews monthly (for monthly and per-creation memberships) or annually (for annual memberships) until you cancel via your membership settings. If your subscription includes a free trial, you will be charged for the first time after the specified free trial period ends, starting an automatically renewing paid subscription on Star Tracker of the type you selected.
You can cancel your free trial or recurring payments at any time. For monthly and annual memberships, canceling or lowering the tier support of your membership will impact your next recurring charge. For per-creation memberships, lowering the tier support of your membership will impact your next per-creation charge, and canceling your membership will go into effect before your next per-creation charge.
Canceling your membership or lowering the tier support below the applicable threshold may result in your loss of access to membership subscription benefits, including a creator’s Star followers-only posts and other benefits. You may also lose access to offerings you’ve purchased and membership subscription benefits under certain circumstances.
Membership subscriptions and offerings vary, and we have limited control over the quality and specific benefits. We attempt to screen for fraudulent creator pages, but cannot guarantee the identity of creators or the validity of any claims they make.
If you are located in a jurisdiction where Star Tracker is required to charge and collect tax, such as VAT or sales tax, that tax is added to the total charge. Star Tracker remits all tax collected to the applicable taxing authority.
We are constantly experimenting with product features to improve Star Tracker and may add, remove, or test features with a subset of Star Followers. Access to these features is not guaranteed and may not be subject to your control. Instead, we may enable and disable these early-access, beta, or test features at our sole discretion.
Refunds. Our policy is not to provide refunds, including if you lose access to offerings and/or membership subscription benefits as described above, though we may allow for some exceptions where refunds are granted at our sole discretion. You can learn more here.


F) Our Role at Star Tracker
Star Tracker’s Role In summary, we may review certain pages and posts on Star Tracker and investigate reported pages to identify potential violations of these terms and our policies.
We regularly review pages and posts on Star Tracker to enforce our terms and policies, including our Community Guidelines and Benefit Guidelines. Additionally, we investigate reports of potential violations. These investigations may take some time to resolve and often involve reviewing activity outside of Star Tracker, primarily because Star Tracker may be exposed to risk based on how funds earned on Star Tracker are used.
In most cases, we aim to work with creators and Star Followers to resolve any potential policy violations, allowing them to continue using Star Tracker. We may terminate creator or Star Followers accounts when we believe it is necessary to protect creators, Star Followers, Star Tracker itself, or the broader community. However, we do not take such actions lightly.
Star Tracker reserves the right to remove a creator or Star Follower from participating in annual memberships. If a creator is removed from participation in annual memberships, the option for further Star Followers to purchase annual subscriptions on Star Tracker for that creator will be removed. If a Star Follower is removed from participation in annual memberships, they will be prohibited from purchasing further annual membership subscriptions on Star Tracker for any creator. However, this will not automatically result in the removal of the creator or Star Follower from Star Tracker, unless there is an independent basis for that removal.

G) Profile Termination
Account Termination In summary, you can delete your account at any time, and we have the right to terminate or disable your account at our discretion.
You can permanently delete your account at any time by visiting our Privacy Center.
We reserve the right to terminate or suspend your account at any time at our sole discretion. Violations against restrictions are deemed very high on our standards and are not treated lightly. Additionally, we can cancel any membership subscriptions and remove any descriptions, posts, offerings, or benefits at our sole discretion. You may not file a claim against us for suspending or terminating another person’s account, and you agree not to bring such a claim. If you attempt to bring such a claim, you will be responsible for any damages caused, including attorneys’ fees and costs. These terms remain in effect even if you no longer have an account.


H) Your Crafted Works
Your Creations In summary, creators retain full ownership of their creations and Star Followers retain full ownership of their posts on Star Tracker, but we need permission to use them as part of Star Tracker’s services. Ensure you have the necessary permissions to post the creations that you make available on Star Tracker.
Creators maintain full ownership of their creations, and Star Followers maintain full ownership of their posts on Star Tracker. However, we require licenses from you for this material to effectively operate Star Tracker’s services. By making creations available on Star Tracker or posting on Star Tracker, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, worldwide license covering your creation or post in all formats and channels now known or later developed anywhere in the world. This license allows us to use, copy, reproduce, store, translate, transmit, distribute, perform, prepare derivative works, publicly display, and display in connection with any name, username, voice, or likeness provided in connection with it. If your creations contain any personal data, you also recognize Star Tracker’s “legitimate interest” in it in accordance with the scope of this license.
While this may seem extensive, it is necessary for us to operate our services, including hosting creations, providing and promoting memberships to your r, and enabling community features like post comments. For clarity, you retain full ownership over your creations and your posts on Star Tracker; we are not purchasing or leasing your intellectual property rights. We will never attempt to steal your creations, exploit them, or profit from them beyond facilitating memberships and offerings you’ve configured on Star Tracker.
You agree not to post creations on Star Tracker that infringe upon others' intellectual property or proprietary rights. Star Tracker reserves the right to remove creations and other materials that violate Star Tracker’s terms and policies, including these Terms of Use and the Community Guidelines. We respond to compliant notifications of claimed copyright infringement and have adopted a policy for terminating, where appropriate, the accounts of creators and Star Followers who are the subject of repeated compliant notifications of claimed copyright infringement or other evidence suggesting a pattern of repeat infringement. Star Followers may not use creations posted by creators in any way not authorized by the creator, including sharing those creations with others who have not purchased the offering or subscription through which those creations were made available.


I) External Applications and Services
Third-Party Apps and Services In summary, you may grant third-party apps and services access to your Star Tracker account, and you may grant Star Tracker access to third-party apps and services. This access can be revoked at any time.
When you connect your Star Tracker account with other websites, apps, or services, you may be asked to grant these third-party services access to information about your Star Tracker account and/or permission to perform actions on your behalf within your Star Tracker account. Should you choose to authorize this, we will follow your instructions and grant the selected access or permissions. More information can be found in our Privacy Policy.


J) Our Own Creations at Star Tracker
Star Tracker's Creations In summary, you agree that any bug reports or suggested improvements that you provide to Star Tracker will be fully owned by Star Tracker. Creators can use our copyrights or trademarks to promote their Star Tracker pages but can’t use them for anything else without our permission.
Our creations, which include elements such as the text on the www.startracker.one site, text on Star Tracker’s other websites, our iOS and Android apps, our APIs, our embeds, our logo, and our codebase, are protected by copyright, trademark, patent, and trade secret laws. We grant creators a license to use our logo and other copyrights or trademarks to promote their Star Tracker pages. The correct use of our logo can be found in our Brand Guidelines. Any other use, reproduction, distribution, performance, public display, or preparation of derivative works of our creations requires our written permission. Please ask if you have any questions.
We appreciate your feedback on the performance of the Star Tracker product, including any early-access, beta, or test features to which you’ve been given access, and your help in identifying any problems, bugs, and defects. You agree that any suggestions, comments, ideas, bug reports, or suggested improvements that you provide to us will be fully owned by us. This allows us to use them to improve Star Tracker and better support the community of creators and Star Followers."


K) Compensation for Loss
Indemnity In summary, if we are sued due to your use of or conduct on Star Tracker, you are responsible for the associated costs.
You will indemnify us from all losses and liabilities, including legal fees, that arise from these terms or relate to your use of Star Tracker. We reserve the right to exclusive control over the defense of any claim covered by this clause. If we exercise this right, you will assist us in our defense. Your obligation to indemnify under this clause extends to our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers.


L) Disclaimer of Warranty
Warranty Disclaimer In summary, we strive to ensure that Star Tracker works as expected, but unforeseen issues can occur.
Star Tracker is provided “as is” and without warranty of any kind. Any warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranties, whether express or implied, are excluded and disclaimed to the greatest extent permitted by law. The disclaimers of warranty under this clause also apply to our subsidiaries, affiliates, and third-party service providers.


M) Restriction of Responsibility
Restriction of Liability In essence: Should you incur losses due to your usage of Star Tracker, any reimbursement is limited to the total sum we have gained through your usage of Star Tracker.
To the maximum extent allowed by law, we bear no responsibility for any incidental, consequential, or punitive damages resulting from these terms, or your usage or attempted usage of Star Tracker. To the maximum extent allowed by law, our liability for damages is restricted to the total sum we have accumulated through your usage of Star Tracker. We are specifically exempt from liability for losses related to unmet offerings and benefits and from losses resulting from conflicting contractual agreements. For the purpose of this clause, “we” and “our” are understood to encompass our subsidiaries, affiliates, officers, directors, employees, agents, and third-party service providers.


N) Conflict Settlement
Resolution of Disputes In summary: Should you encounter a problem; we urge you to communicate with us. Any disagreements with us should be settled in Swedish Cort at Stockholm District under Swedish Law.
We strongly advise reaching out to us if a problem arises. Should a disagreement emerge from these terms or related to your use of Star Tracker, said disagreement will be resolved in the local or state courts situated in Stockholm, Sweden. Both parties agree to the exclusive jurisdiction and venue of the Stockholm, Sweden courts for the purpose of resolving any such disagreements. Swedish law, excluding its conflict of law provisions, governs these terms, all other Star Tracker policies, and any disagreements that may arise between you and Star Tracker.


O) Additional Provisions
Additional Provisions In summary: These terms represent the final say on Star Tracker’s policies and we promise to notify you if we make significant changes to them.
These terms, together with any policies referred to, comprise the full agreement between you and us, replacing all prior agreements, and do not establish any partnership, joint venture, employer-employee or franchisor-franchisee relationship between you and us. If any provision of these terms is deemed unenforceable, that provision is adjusted to the extent required to make it enforceable. If a provision cannot be adjusted to render it enforceable, it is then separated from these terms, with all other provisions remaining in effect. If either party fails to enforce a right provided by these terms, it does not relinquish the ability to enforce any rights in the future.
We may occasionally modify these terms. If we make a change to these terms that we, in our sole discretion, consider significant, we will inform you before the changes come into effect. Using Star Tracker after a change signifies your acceptance of the new terms or policies. 
If you opt to receive text messages from us, you consent to receive recurring automated promotional and personalized marketing texts (e.g., Email, SMS and MMS) messages from us. These may include messages sent via an automatic telephone dialing system, to the mobile number you provided upon sign-up or any other number you specify. Consent to receive automated marketing texts is not a prerequisite for any purchase. Message and data rates may apply. Message frequency may vary. We reserve the right to modify the frequency of messages sent at any time, to increase or decrease the total number of sent messages. We also reserve the right to change the short code or phone number from which messages are sent. Not all mobile devices or handsets may be compatible and our messages may not be deliverable in all areas. We, our service providers, and the mobile carriers supported by the program bear no responsibility for delayed or undelivered messages.
